Examinerships enable companies to be placed under the protection of the court for a period of time (70 to 100 days) while its future prospects and viability are assessed. If protection is granted, an Examiner is appointed by the Court who reviews the company’s affairs, considers its viability and if feasible formulates a proposal or scheme of arrangement for survival.
At MK Brazil we can:
- Accept nominations as an Examiner
- Prepare an Independent Accountant’s report for submission to the High Court when an application for Examinership is being heard
- Provide advice and assistance in preparing an application to the High Court for the appointment of an Examiner
- Provide advice to creditors, directors and other interested parties of their rights and entitlements under the Examinership process
